Main Point
Controlled data creates a candidate advantage through a permitted, testable mechanism that improves the relevant product. Possession and volume do not establish that mechanism.
Key Points
- Inspect the proposed use, rights, relevance, quality and operating cost.
- Compare a concrete data-dependent improvement against an appropriate baseline.
- Keep runtime service access separate from broader training authority.
- Treat each feedback-loop link and competing alternative as an evidence question.
1. Trace a particular benefit
The fictional public summary omits a product exception. A controlled policy contains it. An authorized request may retrieve the applicable passage; a fixed model can then be tested for correct explanation against an independent reference. This is an expected mechanism, not a measured improvement.
Keep the question, model, evaluation rule and access conditions comparable. Separate retrieval success from correct use and track maintenance/review effort. Test relevant missing, stale and unauthorized cases. A single example cannot establish durable superiority, revenue or a unique training advantage.
2. Bound the right to reuse
The fictional agreement permits scoped service retrieval but provides no cross-customer training permission. This assumption applies only to the exercise. Real reuse needs the actual agreement, source rights and applicable qualified review.
Microsoft's models-sold-by-Azure documentation describes separate data-processing and training conditions. It is a provider-specific statement, not a universal contract. [MS-PURPOSE]
CMA's 11 April 2024 statement identifies concerns about control of critical inputs and distribution in foundation-model markets. These competition concerns provide context, not proof of any firm's data moat. [CMA-INPUT]
3. Inspect the feedback process
A feedback item must become evidence: authorized review compares the response with its applicable source, a correction is proposed, and independent testing determines whether the targeted behavior improved. Ratings alone can reflect fluency or selection. More use can create repetition; expert labels and refresh can consume resources.
Ask whether alternatives provide similar value and whether switching difficulty comes from integrations, state, evaluation or habits. Keep these mechanisms distinct from exclusive model-training data. Use the worksheet to identify an unverified link and the evidence needed for a decision, without fabricating commercial outcomes.
4. A dated example
Wu and colleagues' BloombergGPT paper, first posted in March 2023, describes training with Bloomberg financial sources mixed with general-purpose data. Its authors assessed financial, general and internal benchmarks and reported financial-task gains in their comparisons. That is a documented proposal-to-training-to-evaluation pathway, with results reported by the researchers associated with the project. It does not establish a durable data moat, isolate every contribution of proprietary material, or predict our archive's value. The task, mixture, permitted data and actual comparison still matter.
5. Bringing the lesson together
Possession becomes a candidate advantage through a particular permitted use, reliable evidence and a comparison that measures improvement and operating work. You can now challenge each link in the proposed feedback process.

Why might sensitive enterprise data be unsuitable for general model training but useful in the customer's application? Think about the difference between an authorized request and a broader reuse purpose.
Show reasoning
The application may access relevant information under tightly scoped runtime permissions without granting general training or cross-customer reuse rights. Use-specific value and broader reuse authority are separate questions. Verify the actual conditions rather than assuming either permission or prohibition from the word proprietary.
